These Terms and Conditions (“Terms”) form a binding legal agreement that governs your access to and use of the services and the proprietary digital platform operated by Speedy Sticks LLC (“Speedy Sticks,” “we,” “our,” or “us”). Please read them carefully. They include important provisions that limit our liability, require you to assume certain risks, and require disputes to be resolved by binding individual arbitration with a class-action waiver (Section 21). By booking, accessing, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and all policies referenced or presented at booking. If you do not agree, do not book or use our services.
1. Overview of services
Speedy Sticks LLC is a national mobile specimen collection and healthcare logistics provider. We provide:
- Mobile phlebotomy services
- Specimen collection (blood, urine, saliva, specialty kits)
- In-home, on-site, and facility-based collections
- Specimen handling, processing, and delivery logistics
- Coordination through proprietary scheduling and operations software
Important:
- Speedy Sticks is not a clinical laboratory and does not perform testing, diagnosis, or medical interpretation.
- All specimens are processed by third-party CLIA-certified laboratories.
- We do not provide medical advice, and nothing we communicate constitutes a diagnosis, treatment recommendation, or substitute for the care of your licensed healthcare provider.
- Our services do not create a physician–patient relationship between you and Speedy Sticks. All clinical decisions, orders, and follow-up remain the responsibility of your ordering provider.
2. Platform & technology
Speedy Sticks operates through proprietary digital infrastructure (the “Platform”), which governs:
- Scheduling and appointment booking
- Technician dispatch and routing
- Real-time tracking and status updates
- Communication between patients, providers, and staff
- Specimen tracking and chain-of-custody logs
- Documentation and requisition management
2.1 System authority
All platform-generated records (timestamps, logs, confirmations) are considered official and legally binding records of service activity, absent clear evidence of error.
2.2 Availability disclaimer
While we strive for continuous uptime:
- Platform interruptions may occur
- Third-party services (SMS, email, APIs) may fail
- Speedy Sticks is not liable for outages beyond reasonable control
3. Eligibility
- You must be 18 or older to book services.
- If you book or schedule services for another person, including a minor or dependent, you represent and warrant that you have the legal authority and consent to do so and to accept these Terms on their behalf.
- Collection for a minor requires the presence and consent of a parent or legal guardian unless otherwise permitted by applicable law and arranged in advance.
- You agree to provide accurate, current, and complete information, and government-issued identification may be required at the time of service.
4. Scheduling & appointment terms
4.1 Appointment window
- Appointments are scheduled in time windows (typically one hour).
- Technicians may arrive at any point within that window.
- Failure to be present constitutes a no-show and is not eligible for a refund.
4.2 Operational variability
Arrival times may be affected by traffic, weather, prior appointments, and routing.
We do not guarantee exact arrival times.
4.3 Client preparation (strict)
You are responsible for:
- Patient readiness (fasting, hydration, and similar requirements)
- Valid lab orders or complete kits
- Correct instructions
Failure to meet preparation requirements may cause the service to fail without refund.
5. Payment & pricing
5.1 Payment terms
- Payment is required upfront unless enterprise billing applies.
- Accepted methods include credit and debit cards and other platform-supported payments.
- You authorize us and our payment processors to charge your selected payment method for all amounts due, including applicable additional fees described in these Terms.
5.2 Pricing structure
Pricing may vary based on location, distance or travel, urgency (including STAT or same-day), complexity (kits, processing, and similar factors), and volume.
5.3 Dynamic pricing disclosure
Platform estimates may differ from final charges. Final pricing is determined by operational logistics and service execution requirements.
5.4 Chargebacks
Initiating a chargeback or payment dispute for services that were dispatched or rendered in accordance with these Terms is a breach of this agreement. We reserve the right to contest such disputes, recover amounts owed and related costs, and suspend future service.
6. Refund policy
There are no refunds once a technician is dispatched or arrives.
This includes when:
- The patient is unavailable
- Paperwork is missing
- Preparation was improper
- The draw is difficult or unsuccessful
Refunds are issued only if Speedy Sticks cancels your appointment without a rescheduling option, as described in our policies at booking.
7. Rescheduling & cancellations
- You must cancel or reschedule at least 24 hours in advance unless a different window is stated at booking or in your agreement.
- Late changes may incur fees (for example, $50 or more).
- Same-day changes are not guaranteed.
8. Specimen handling & client responsibility
Speedy Sticks follows industry best practices, including proper labeling, chain-of-custody procedures, and lab-specific instructions when applicable.
You remain responsible for valid orders, lab acceptance rules, special handling instructions, and kit completeness.
8.1 No liability for kit issues
We are not responsible for missing components, damaged kits, incorrect instructions, or delayed kit shipments.
8.2 Transfer of responsibility
Once a specimen is shipped or delivered to the laboratory, responsibility transfers to the lab and carrier as applicable.
9. Assumption of risk & medical acknowledgment
You understand that specimen collection, including venipuncture (blood draw), is a medical procedure that carries inherent risks even when performed competently. These risks include, without limitation, pain, bruising, hematoma, bleeding, lightheadedness or fainting, nerve irritation, swelling, and, rarely, infection or other complications.
By booking and receiving services, you voluntarily accept and assume these inherent risks. You agree to disclose, in advance and accurately, any medical conditions, medications (including blood thinners), allergies, prior reactions, or other factors relevant to a safe collection. Speedy Sticks is not responsible for outcomes arising from undisclosed or inaccurate health information.
If you experience a medical emergency at any time, call 911 or seek immediate medical attention. Speedy Sticks does not provide emergency or urgent medical care.
10. Disclaimer of warranties
Except where prohibited by law, all services and the Platform are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Speedy Sticks disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that a draw will be successful on the first or any attempt, that any specimen will be accepted by a laboratory, that the Platform will be uninterrupted or error-free, or that any particular result, outcome, or turnaround time will be achieved.
11. Limitation of liability
To the fullest extent permitted by law, Speedy Sticks, its owners, members, officers, employees, and independent contractors are not liable for lab errors or delays, rejected specimens, medical outcomes, patient reactions, missed deadlines, lost or spoiled specimens once transferred to a lab or carrier, or any indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, data, or goodwill, even if advised of the possibility of such damages.
Our total aggregate liability for any claim relating to a specific service is limited to the amount you actually paid to Speedy Sticks for that service. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Speedy Sticks and its owners, members, officers, employees, and independent contractors from and against any claims, demands, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your provision of inaccurate or incomplete information, your violation of any law or the rights of any third party, unsafe conditions at the service location, or your authorization of services on behalf of another person without proper authority or consent.
13. Insurance & service model
- Speedy Sticks is a private, out-of-pocket service.
- We are not an insurance provider and do not accept insurance for our collection service.
- We are not a billing entity for laboratories.
- You are responsible for reimbursement inquiries with your plan or administrator.
14. Independent contractor structure
Technicians are independent professionals who are trained and vetted. Speedy Sticks acts as a coordination, logistics, and platform provider. No employer-employee relationship between you and technicians is created by these Terms.
15. Client conduct
You must provide a safe environment, treat staff professionally, restrain pets, and disclose relevant risks. We may refuse service if conditions are unsafe. No refund applies when service is refused for safety reasons.
16. Consent to collection & services
A signed consent form authorizing specimen collection is required before service. Refusal to provide required consent means no service and no refund.
17. HIPAA & data security
17.1 HIPAA compliance
We maintain administrative, physical, and technical safeguards appropriate to protected health information we handle.
17.2 Security infrastructure
We use secure systems including encrypted transmission, access controls, and audit logging where applicable. Speedy Sticks uses HIPAA-compliant infrastructure on Amazon Web Services (AWS) and Microsoft Azure—including regions and services configured for regulated workloads—with administrative, physical, and technical safeguards and business associate agreements (BAAs) or equivalent arrangements where applicable to our use of those services. Telephone and fax services are provided through a HIPAA-compliant RingCentral account with appropriate safeguards and vendor agreements. Email, calendar, file storage, and collaboration use Google Workspace with HIPAA-eligible services and settings enabled, and business associate agreements or equivalent arrangements where applicable.
17.3 PHI responsibility
You are responsible for lawful sharing of patient data and the accuracy of information you submit.
18. Telephone, SMS & electronic communications
By providing your contact information and using our services, you consent to receive communications from Speedy Sticks electronically, including by email, telephone call, and text message (SMS), for transactional and service-related purposes such as scheduling, confirmations, dispatch updates, and account notices.
Message and data rates may apply, and message frequency varies. You may opt out of non-essential text messages at any time by replying STOP; certain service-critical messages may still be sent as needed to deliver the service you requested. You agree that electronic communications, agreements, and acceptances satisfy any legal requirement that such communications be in writing.
19. Intellectual property & platform license
The Platform and all related software, content, trademarks, logos, designs, and materials are owned by Speedy Sticks or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform solely to book and manage your services.
You may not copy, modify, distribute, reverse engineer, scrape, resell, or create derivative works from any part of the Platform, or use it to build a competing service, except as expressly permitted by law. All rights not expressly granted are reserved.
20. Force majeure
We are not liable for delays caused by weather, natural disasters, system outages, government actions, transportation issues, or other events outside our reasonable control.
21. Dispute resolution, arbitration & class waiver
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Except for matters that may be brought in small-claims court, you and Speedy Sticks agree that any dispute, claim, or controversy arising out of or relating to these Terms or our services will be resolved by final and binding arbitration administered on an individual basis, and not by a court or jury.
You and Speedy Sticks waive any right to participate in a class action, class arbitration, or other representative proceeding, to the fullest extent permitted by law. The seat and venue for arbitration, and for any permitted court proceeding, shall be Palm Beach County, Florida.
To the extent permitted by law, any claim must be brought within one (1) year after the event giving rise to it, or it is permanently barred. If the class-action waiver is found unenforceable as to any portion of a claim, that portion shall proceed in court, while the remainder is arbitrated.
22. Non-performance & termination
We may refuse, suspend, or terminate service for repeated no-shows, non-payment, chargeback abuse, abuse of staff, misuse of the Platform, unsafe conditions, or violation of these Terms.
23. Results disclaimer
Speedy Sticks does not receive, store, deliver, or interpret test results, and results are never made available within the Speedy Sticks platform. All results are reported by the laboratory to your ordering provider. Follow-up must be with your ordering provider and laboratory.
24. Additional fees
Additional charges may include travel fees, after-hours fees, parking or tolls, and specialized handling, as disclosed at booking.
25. Digital agreement & electronic signature
By booking or using services, you confirm that you have read and agree to these Terms and related policies. Signature or electronic acceptance may be required prior to service, and your electronic acceptance has the same legal effect as a handwritten signature.
26. Assignment
You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent. Speedy Sticks may assign these Terms, in whole or in part, including in connection with a merger, acquisition, reorganization, or sale of assets. These Terms bind and benefit the parties and their permitted successors and assigns.
27. General provisions
These Terms, together with the policies and agreements presented at booking, constitute the entire agreement between you and Speedy Sticks regarding our services and supersede all prior understandings on that subject. If any provision is held unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Our failure to enforce any provision is not a waiver of it. Section headings are for convenience only. There are no third-party beneficiaries to these Terms. Provisions that by their nature should survive termination—including limitations of liability, disclaimers, indemnification, and dispute resolution—will survive.
28. Modifications
We may update these Terms at any time. Changes are effective when posted with an updated “Last updated” date, and your continued use of our services after changes constitutes acceptance of the updated Terms.
29. State-specific compliance
Speedy Sticks operates as a specimen collection and logistics provider, not a laboratory, and intends to comply with applicable laws in the states where it operates, including California. Nothing in these Terms is intended to waive any right or protection that cannot lawfully be waived under the law applicable to you.
